Terms & Conditions
1. It is mutually agreed that this policy covers only electrically operated units
inside the equipment and does not cover electrical or plumbing work beyond
the units or work required due to the negligence or misuse of the equipment
or because office, flood, acts of God, sabotage of electrical, gas or water
supply or damage caused by freezing or circumstances beyond our control.
2. Magnolia reserves the right to reject any policy if an inspection by our
service technicians find the equipment is in such condition that service will
be unsatisfactory to both parties. The equipment must be brought up to
industry standards at the customer’s expense before acceptance of policy at
the time of the 1st maintenance check.
3. Magnolia shall not be responsible for system design or performance in
maintaining design conditions except through failure of equipment covered
herein.
4. Services not included within the scope of this agreement are: 1. Pulling and
cleaning blower wheels. 2. Adding refrigerant. 3. Cleaning of equipment
which is not readily accessible by access panels or proper service
clearances. 4. Routine service calls. Replacement parts such as air filters,
filter media, oil filters, nozzles, belts, strainers, humidifier pads and ultra
violet lamps are not included in this agreement. If these parts are not
stocked on our service truck or on site at the time of inspection, there will
be an additional charge to make an extra visit. Cleaning compounds and
lubricants are included with each tune up.
5. The services listed in item 4 will be performed if necessary provided the
customer authorizes Magnolia to proceed with the work and the customer
agrees to pay the agreed upon price for that work. Routine service calls will
be quoted by Magnolia Customer Service at the time the service calls are
placed by the customer.
6. Agreement is transferable to new property owner with proof of deed.
7. Magnolia reserves the right to terminate this agreement if any changes,
adjustments or repairs are made by others unless approved in writing by
Magnolia.
8. Magnolia will not be required to furnish without extra cost any items of
material, labor or equipment which are recommended or required by local
care regulations, insurance companies, Government, State, Municipalities.
9. Magnolia does not guarantee that drain lines are clear after the inspection and
can no way be liable for any damage caused by backed up drain lines, cracked
pans, faulty safety switches or anything similar thereto. This agreement is not
an insurance policy and is not designed to compensate the customer for loss
or damages.
10. Magnolia will endeavor to render prompt and efficient service hereunder, but
it is expressly agreed that Magnolia shall in no event be liable for damage or
loss caused by delay or any loss arising out of performance of this agreement.
11. This agreement is automatically renewable yearly, but may be terminated by
either party upon thirty (30) days written notice of its intention to terminate.
A refund for remaining contract period will be made on a prorated basis, with
deductions for work already completed.
12. The Fifteen Percent Discount on repairs applies only to repairs on equipment
listed under this agreement and during the lifetime of this agreement.
13. All of the benefits of the Magnolia USA Agreement, aka Ultimate Savings
Club Agreement shall terminate at the time the agreement terminates.
14. The FiveYear Service GuaranteeWith No Overtime applies only to repairs on
equipment listed under this agreement and remains only in effect for the
lifetime of the Ultimate SavingsAgreement. The FiveYear Service Guarantee
With No Overtime shall terminate at the time the customer terminates his/her
Ultimate Savings Agreement and therefore terminates membership in the
Magnolia USA Club. All prior repair warranties would end at time of
termination.
15. Service calls will not be scheduled beyond normal working hours ofMonday
thru Friday 7:30 am - 4 pm or holidays unless the customer is experiencing
an emergency outage such as no heat or air conditioning.
